MAIN CHANGES AND OUR SOLUTIONS:
End of Section 21 Notices: Section 21 “no-fault” evictions will be abolished. Landlords will instead need to rely on Section 8 notices, using specific mandatory or discretionary grounds.
Our solution: We advise landlords on the correct grounds for possession under Section 8 and ensure the correct notice periods are followed.
End of Fixed-Term ASTs: All fixed-term Assured Shorthold Tenancies (ASTs) will move to periodic (rolling) tenancies with no fixed end date. Tenants will be able to give two months’ written notice at any time.
Our solution: We market the property as soon as notice is received to minimise void periods and secure new tenants quickly.
Annual Rent Increases: Rent increases will be limited to once per year and must reflect market conditions, using a Section 13 notice.
Our solution: We use our in-depth market knowledge to set appropriate rental levels and ensure all increases are compliant.
Restrictions on Rent in Advance: Landlords will no longer be able to request multiple months’ rent in advance.
Our solution: We carry out thorough referencing and due diligence during the application process to secure reliable tenants.
New Landlord Register: A new landlord database will record details of landlords, their properties, and any enforcement action taken.
Our solution: We ensure our managed landlords meet all registration requirements and remain fully compliant.
Fair Dispute Resolution: A Landlord Ombudsman will be introduced to resolve disputes between landlords and tenants impartially.
Our solution: We support landlords throughout any disputes and manage the process on your behalf.
Inclusive Lettings: Discrimination against tenants with children, pets, or those receiving benefits will be prohibited.
Our solution: We advise landlords on appropriate insurance policies and tenancy agreements to accommodate these changes.
ADDITIONAL KEY CHANGES AND COMPLIANCE AREAS
Minimum Property Standards: All rental properties will be required to meet stricter condition standards, likely aligned with the Decent Homes Standard.
Our solution: We carry out regular property inspections and coordinate any required maintenance to ensure your property meets all legal standards.
Stronger Tenant Rights on Repairs: Tenants will have increased powers to challenge poor property conditions and delays in repairs.
Our solution: We proactively manage maintenance issues, ensuring repairs are handled quickly and professionally to avoid complaints or enforcement action.
Greater Rights for Tenants with Pets: Tenants will have stronger rights to request permission for pets, and landlords must provide a valid reason for refusal.
Our solution: We guide landlords on pet policies, including appropriate clauses and insurance considerations to protect your property.
Increased Enforcement and Penalties: Local authorities will have greater powers to enforce regulations, including issuing fines and penalties for non-compliance.
Our solution: We ensure full compliance across all areas of property management, reducing your risk of enforcement action.
